CarOptions – U.S. Terms & Conditions

These Terms & Conditions (“Terms”) govern your purchase and use of CarOptions products in the United States, including the CarPlayBox (the “Product”), and our website, services, and content (collectively, the “Services”). By accessing our Services or purchasing a Product, you agree to these Terms.

Seller / Entity: Sales under these Terms are made by CarOptions B.V. (“CarOptions,” “we,” “us,” “our”).

IMPORTANT SAFETY NOTICE (CONSPICUOUS)

DO NOT OPERATE OR ADJUST THE PRODUCT WHILE DRIVING. THE PRODUCT IS AN AFTERMARKET INFOTAINMENT ACCESSORY AND IS NOT A SAFETY OR EMERGENCY SYSTEM. IMPROPER INSTALLATION OR USE CAN INCREASE RISK OF FIRE, ELECTRICAL DAMAGE, OR ACCIDENTS. ALWAYS FOLLOW ALL APPLICABLE TRAFFIC LAWS.

1. Eligibility & Accounts

1.1 You must be at least the age of majority in your state to purchase.
1.2 You are responsible for ensuring the accuracy of all information you provide, including shipping details.

2. Orders, Pricing & Taxes

2.1 We may accept or reject orders at our discretion. Availability, descriptions, and prices are subject to change without notice.
2.2 Prices are listed in U.S. Dollars (USD).
2.3 Applicable U.S. sales taxes will be calculated at checkout.
2.4 CarOptions will be responsible for U.S. import duties and taxes; no additional import fees are due at delivery.

3. Payments & Fraud Prevention

3.1 Orders are final only upon receipt of full payment.
3.2 We may verify transactions for security. Orders may be cancelled and refunded if we cannot confirm legitimacy.
3.3 By placing an order, you authorize us to charge your payment method for the total amount.

4. Shipping; Title; Risk of Loss; Delivery Estimates

4.1 We ship via reputable carriers (UPS, DHL, FedEx, USPS).
4.2 FOB Origin: title and risk of loss transfer to you once the Product is given to the carrier.
4.3 Delivery dates are estimates only. We are not responsible for delays outside our control.
4.4 Damaged Packages: Do not accept visibly damaged shipments. If you do, damage may be deemed your responsibility.
4.5 Failed delivery due to refusal, absence, or unpaid fees may result in return; you are responsible for related costs plus restocking fees.

5. Product Use & Safety

5.1 DO NOT USE WHILE DRIVING.
5.2 Certain “video in motion” or app features may be illegal in your jurisdiction. You are solely responsible for compliance.
5.3 Professional installation recommended. Incorrect installation is at your own risk.
5.4 CarOptions is not responsible for electrical issues, third-party installers, or modifications.
5.5 Product must not replace attentive driving or OEM safety systems.

6. Compliance; FCC; Modifications

6.1 FCC Part 15 Notice: The Product uses Wi-Fi/Bluetooth and must not cause harmful interference. It must accept interference received.
6.2 Unauthorized modifications may void FCC authorization and your warranty.
6.3 Do not open, reverse engineer, or tamper with the Product.

7. Returns & RMA

7.1 Return window: 30 days from delivery.
7.2 Condition: returns only if unused, unopened, in original packaging with all seals intact. Installed/opened units are not returnable.
7.3 Vehicle-specific/custom-configured Products are non-returnable.
7.4 RMA authorization is required; returns without RMA will be refused.
7.5 A 15% restocking fee applies. Shipping costs are non-refundable.
7.6 Refunds issued only after inspection confirms eligibility. Missing/damaged parts may increase fees.

8. Limited Warranty (12 Months)

8.1 Coverage: 12 months from delivery against defects in materials/workmanship under normal use.
8.2 Remedy: repair, replacement, or refund at our discretion. This is your exclusive remedy.
8.3 Exclusions: damage from improper installation, misuse, accidents, water, modifications, cosmetic wear, or use with unapproved devices.
8.4 Warranty is non-transferable.
8.5 Implied warranties (merchantability/fitness) limited to 12 months, where permitted by law.

9. Warranty Procedure

9.1 Contact support for troubleshooting before RMA issuance.
9.2 Proof of purchase required.
9.3 Photos/videos may be requested to verify defects.

10. Disclaimers

THE PRODUCT AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” EXCEPT FOR THE EXPRESS WARRANTY ABOVE, CAROPTIONS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

11. Limitation of Liability (CONSPICUOUS)

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • OUR TOTAL LIABILITY SHALL NOT EXCEED THE PURCHASE PRICE YOU PAID.

  • WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, USE, OR VEHICLE VALUE.

12. Indemnification

You agree to indemnify and hold CarOptions harmless from any claims, losses, damages, or expenses (including attorneys’ fees) arising from:

  • your use or installation of the Product,

  • use while driving,

  • violation of law or these Terms,

  • third-party installer work,

  • modifications or misuse.

13. Software; Updates; Third-Party Services

13.1 We may provide software/firmware updates. You are responsible for installing updates designated as important.
13.2 Third-party apps/services may change or discontinue; CarOptions is not responsible for them.

14. Intellectual Property & OEM Disclaimer

14.1 All CarOptions content, trademarks, and software are proprietary.
14.2 By submitting reviews, photos, or content, you grant CarOptions a license to use them for marketing.
14.3 CarOptions is not affiliated with Apple, Google, BMW, Mercedes-Benz, or any other OEM. Trademarks remain the property of their owners.

15. User Content & DMCA

15.1 Reviews/comments must be truthful, lawful, and non-infringing.
15.2 CarOptions reserves the right to remove inappropriate content.
15.3 Copyright complaints: email support@caroptions.com with subject “DMCA Notice” and required information.

16. Privacy

Use of Services is subject to our Privacy Policy. Until a U.S.-specific policy is published, our EU Privacy Policy applies.

17. Prohibited Uses

You may not use the Product or Services for:

  • illegal purposes,

  • distracted driving,

  • reverse engineering,

  • resale in violation of law,

  • uploading harmful code.

18. State-Specific Consumer Notices

  • New Jersey: limitations of warranties and remedies are intended to be enforceable to the maximum extent permitted.

  • California: disclaimers and limitations herein are intended to be conspicuous and enforceable to the extent allowed.

19. Dispute Resolution; Arbitration; Class Action Waiver

19.1 Governing law: Delaware law.
19.2 Binding arbitration: All disputes resolved by AAA or JAMS arbitration under the Federal Arbitration Act.
19.3 Venue: Delaware (remote participation permitted).
19.4 CLASS ACTION WAIVER: YOU MAY ONLY BRING CLAIMS INDIVIDUALLY, NOT AS PART OF A CLASS OR REPRESENTATIVE ACTION.
19.5 Opt-out: you may opt out within 30 days by emailing support@caroptions.com

20. Miscellaneous

20.1 Force Majeure: we are not liable for delays beyond our control.
20.2 Severability: if one provision is invalid, the rest remain enforceable.
20.3 Assignment: you may not assign rights without our consent.
20.4 Entire Agreement: these Terms are the complete agreement.
20.5 Changes: we may update these Terms; continued use = acceptance.
